General Terms and Conditions for Event Locations

We are happy to accept your reservation in writing by post, telephone, online booking or email.
Terms of use
The event location/event kitchen is available to the tenant by arrangement. We ask you to vacate the event location/event kitchen by 2.00 pm on the day the event ends. Extended times are possible on request and subject to availability. The hirer may only use the event location for the event purpose specified by the hirer. The subletting or re-letting of the location provided as well as invitations to job interviews and sales events require prior consent. Necessary preparation times for set-up, decoration and dismantling etc. must be taken into account by the hirer accordingly.

Payment agreements
With the booking confirmation we ask for a deposit of 30% of the total price. Please state the booking number as the reason for payment. The deposit is due for payment within 8 days after the reservation has been made. It is also possible to pay the full price immediately. Please pay the balance at least 3 weeks before arrival by bank transfer.

Cancellation policy
Free cancellation up to 8 weeks before date of arrival. Cancellations made after this date will be charged at 70 percent of the price. Cancellations made up to one day before the date of arrival will be charged at 90 percent of the price. Cancellations made late or in the event of no-shows will be charged the full amount.

Faults and requests for redress
As the tenant, you must notify us immediately of any defects or faults that hinder the use of the event station and other rental items. We undertake to remedy any reported defects as quickly as possible. If an immediate remedy cannot be achieved or can only be achieved with disproportionate effort, a reasonable reduction of the co-payment will be made. The tenant is obliged to do what can reasonably be expected of him in order to remedy the fault and minimise any possible damage.

Liability
Our event location/event kitchen is in accordance with the statutory provisions. Use of the facilities is at your own risk and responsibility. We accept no liability for services provided by our partners. If the hirer equips the location themselves for their event (e.g. decorating), then only flame-retardant objects/materials may be used and these must be securely installed/attached. The hirer must expressly ensure that this is the case and must assume responsibility and liability for this (fire, accidents/injuries, etc.). Fireworks in the open air (car park/around the house) may be permitted by the landlord on presentation of an official permit. If permission is granted, the tenant bears the full risk of the fireworks display. This applies to personal injury and damage to property in and around the house (including outside the landlord's property if this is affected or damaged by the fireworks). The tenant must ensure that all residues on the landlord's premises and also outside the premises are removed. The tenant shall be fully liable for the consequences of failure to ensure that no residue is left behind.

Liability for damage / noise and fire protection
The tenant is the organiser of the event intended to be held in the rented rooms. He has the legally required licences and fulfils all the necessary official requirements. Bergdorf Spessart may at any time require the hirer to provide appropriate security (e.g. insurance, €400.00 deposit) etc. Bergdorf Spessart is liable for claims for damages by the tenant - regardless of the legal grounds - up to the amount of the typically foreseeable damage. Liability for loss of profit is excluded. This also applies to the culpable breach of an obligation, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the customer could rely ("cardinal obligation"). The aforementioned limitations of liability shall not apply in the event of: a) wilful or grossly negligent damage, b) culpable injury to life, limb or health.

Technical equipment and connections
The use of own electronic equipment (e.g. electric amplifiers) is permitted. In principle, only slightly acoustically amplified live music is permitted at the event station. Any faults or damage to our technical equipment caused by the use of such equipment shall be borne by the hirer, unless we are responsible for them. We can record and charge a flat rate for the electricity costs incurred through use. The statutory rest periods must be observed and any consequences are borne by you as the tenant.

Smoking
Please note that smoking is not permitted in the entire event kitchen due to hygiene measures. Smoking is also not permitted anywhere on the event site if there is an acute risk of forest fires. The lighting of open fires, decorations with table fireworks, fireworks, sparklers and other flammable objects is expressly prohibited.

Final provisions
Amendments and additions to the contract, the acceptance of the application or these General Terms and Conditions shall be made in writing. Unilateral amendments or additions by the guest shall not be recognised and shall be invalid. The place of fulfilment and payment is Flörsbachtal. German law shall apply to the exclusion of international private law. The exclusive place of jurisdiction is Gelnhausen if the tenant is a merchant, a legal entity under public law or a special fund under public law. Should individual provisions be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply. Brochures, route descriptions and price lists are prepared with the utmost care. Nevertheless, errors, printing and calculation errors are reserved. By concluding the contract, the guest agrees that his/her personal data may be stored and used for further advertising purposes. The customer is responsible for compliance with any passport, visa, customs, foreign exchange and health regulations.
